REGULAMIN REZERWACJI I POBYTU

MOUNTALA

  1. Niniejszy Regulamin określa zasady dokonywania rezerwacji oraz korzystania z apartamentów znajdujących się w obiekcie MOUNTALA, zwanym dalej „Obiektem”.
  2. Użyte w Regulaminie określenia oznaczają:
    1. Obiekt – Mountala;
    2. Apartament – apartament, pokój lub inny lokal noclegowy znajdujący się w Obiekcie i objęty Rezerwacją;
    3. Gość – osoba dokonująca Rezerwacji lub korzystająca z Apartamentu;
    4. Wynajmujący – GÓRSKA GRUPA HOTELOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ z siedzibą w Zakopanem, ul. Chyców Potok 26/P.II, 34-500 Zakopane, wpisana do rejestru przedsiębiorców Krajowego Rejestru Sądowego pod numerem KRS: 0001095970, NIP: 7361748232;
    5. Buch – umowa dotycząca odpłatnego udostępnienia Apartamentu Gościowi w określonym terminie;
    6. Oferta elastyczna – oferta umożliwiająca anulowanie Rezerwacji na warunkach określonych w niniejszym Regulaminie;
    7. Oferta bezzwrotna – oferta, w której Gość rezygnuje z możliwości bezkosztowego anulowania Rezerwacji.
  3. Kontakt z Wynajmującym możliwy jest:
    • e-mail: rezerwacja@gorskagrupa.pl;
    • telefonicznie – dział rezerwacji: +48 535 391 391;
    • pisemnie: ul. Chyców Potok 26/P.II, 34-500 Zakopane.
  1. Dokonanie Rezerwacji oznacza, że Gość zapoznał się z niniejszym Regulaminem, zaakceptował jego treść oraz zobowiązuje się do przestrzegania jego postanowień.
  2. Gość dokonujący Rezerwacji w imieniu innych osób zobowiązany jest przekazać im treść Regulaminu.
  3. Gość odpowiada za przestrzeganie Regulaminu przez wszystkie osoby objęte jego Rezerwacją, osoby małoletnie pozostające pod jego opieką oraz osoby odwiedzające.
  4. Umowa pomiędzy Gościem a Wynajmującym może zostać zawarta poprzez dokonanie Rezerwacji za pośrednictwem strony internetowej, systemu rezerwacyjnego, poczty elektronicznej, telefonicznie, za pośrednictwem zewnętrznych portali rezerwacyjnych lub w inny sposób zaakceptowany przez Wynajmującego.
  5. Ceny prezentowane w kanałach sprzedaży mogą ulegać zmianie. Gościa obowiązuje cena wskazana w otrzymanym potwierdzeniu Rezerwacji.
  6. W cenę pobytu wliczone są standardowe opłaty za zużycie mediów, chyba że warunki konkretnej oferty stanowią inaczej.
  7. Zdjęcia Apartamentów mają charakter informacyjny. Dopuszczalne są nieznaczne różnice dotyczące dekoracji, ustawienia wyposażenia lub jego wyglądu, jeżeli nie wpływają one istotnie na standard, funkcjonalność i przeznaczenie Apartamentu.
  1. Rezerwacji można dokonać:
    1. za pośrednictwem dostępnego systemu rezerwacyjnego;
    2. pocztą elektroniczną na adres: rezerwacja@gorskagrupa.pl;
    3. telefonicznie pod numerem: +48 535 391 391;
    4. za pośrednictwem współpracujących portali rezerwacyjnych.
  2. W celu dokonania Rezerwacji Gość zobowiązany jest podać prawdziwe i kompletne dane wymagane do jej realizacji, w szczególności:
    1. imię i nazwisko;
    2. adres poczty elektronicznej;
    3. numer telefonu;
    4. termin pobytu;
    5. liczbę osób;
    6. liczbę i wiek dzieci;
    7. inne informacje niezbędne do realizacji Rezerwacji.
  3. Gość zobowiązany jest niezwłocznie poinformować Wynajmującego o zmianie danych podanych podczas dokonywania Rezerwacji.
  4. Po dokonaniu Rezerwacji Wynajmujący przesyła Gościowi potwierdzenie zawierające w szczególności:
    1. termin pobytu;
    2. nazwę lub numer Apartamentu;
    3. liczbę Gości;
    4. cenę pobytu;
    5. wysokość i termin wymaganej płatności;
    6. warunki anulowania Rezerwacji;
    7. informacje dotyczące zameldowania.
  5. Rezerwacja zostaje potwierdzona po jej zaakceptowaniu przez Wynajmującego oraz dokonaniu wymaganej płatności.
  6. Brak wymaganej płatności w terminie może skutkować anulowaniem Rezerwacji.
  7. W przypadku Rezerwacji dokonanej za pośrednictwem zewnętrznego portalu rezerwacyjnego zastosowanie mogą mieć również warunki tego portalu. W zakresie płatności, zmian i anulowania Rezerwacji pierwszeństwo mają warunki zaakceptowane przez Gościa podczas dokonywania Rezerwacji w danym kanale sprzedaży.
  1. W przypadku skorzystania z Oferty elastycznej Gość zobowiązany jest do zapłaty 100% wartości Rezerwacji w momencie jej dokonania.
  2. Gość korzystający z Oferty elastycznej ma prawo anulować Rezerwację i otrzymać zwrot 100% wpłaconej kwoty, jeżeli anulowanie nastąpi:
    1. najpóźniej 5 dni przed planowanym przyjazdem – w przypadku Rezerwacji w sezonie niskim;
    2. najpóźniej 14 dni przed planowanym przyjazdem – w przypadku Rezerwacji w sezonie wysokim oraz w terminach specjalnych.
  3. Przez terminy specjalne rozumie się w szczególności:
    • święta i okresy okołoświąteczne;
    • ferie zimowe;
    • długie weekendy;
    • okres sylwestrowy i noworoczny;
    • wakacje;
    • inne okresy wskazane jako specjalne w warunkach konkretnej oferty.
  1. Terminy sezonu niskiego i wysokiego mogą zmieniać się w poszczególnych latach.
  2. Informacja o warunkach dotyczących konkretnej Rezerwacji przekazywana jest Gościowi przed jej potwierdzeniem.
  3. W przypadku anulowania Rezerwacji w terminie uprawniającym do bezpłatnej anulacji całość wpłaconych środków zostanie zwrócona w terminie do 7 dni roboczych od skutecznego złożenia oświadczenia o anulowaniu.
  4. W przypadku anulowania Rezerwacji po upływie terminów wskazanych w ust. 2 wpłacona cena Rezerwacji nie podlega zwrotowi.
  5. Jeżeli Rezerwacja dokonywana jest w terminie krótszym niż okres umożliwiający bezpłatne anulowanie, wymagana jest płatność 100% wartości Rezerwacji, a wpłacona kwota nie podlega zwrotowi w przypadku anulowania Rezerwacji przez Gościa.
  6. Oświadczenie o anulowaniu Rezerwacji należy przesłać na adres:

rezerwacja@gorskagrupa.pl

lub złożyć w inny sposób wskazany w potwierdzeniu Rezerwacji.

  1. Wynajmujący może oferować szczególne warunki pobytu w ramach Oferty bezzwrotnej.
  2. W przypadku Oferty bezzwrotnej Gość zobowiązany jest do zapłaty 100% wartości Rezerwacji w momencie jej dokonania.
  3. W przypadku anulowania Rezerwacji przez Gościa wpłacona cena nie podlega zwrotowi.
  4. Bezpłatna zmiana terminu lub innych warunków Rezerwacji bezzwrotnej nie jest możliwa, chyba że Wynajmujący wyrazi na to indywidualną zgodę.
  1. Modyfikacja Rezerwacji, w tym zmiana terminu pobytu, Apartamentu, liczby Gości lub zakresu usług, możliwa jest wyłącznie po uzyskaniu zgody Wynajmującego.
  2. Możliwość dokonania zmiany zależy w szczególności od:
    1. dostępności Apartamentów;
    2. warunków wybranej oferty;
    3. aktualnych cen;
    4. terminu pozostałego do rozpoczęcia pobytu.
  3. Zmiana Rezerwacji jest skuteczna po jej potwierdzeniu przez Wynajmującego w wiadomości elektronicznej lub na innym trwałym nośniku.
  4. Gość może przenieść Rezerwację na inną osobę po uzgodnieniu tego z Wynajmującym.
  5. Osoba przejmująca Rezerwację zobowiązana jest zaakceptować jej warunki oraz przekazać dane niezbędne do realizacji pobytu.
  1. Doba hotelowa rozpoczyna się o godzinie 16:00 w dniu przyjazdu i kończy o godzinie 11:00 w dniu wyjazdu.
  2. W Obiekcie Mountala obowiązuje zdalny sposób zameldowania.
  3. Standardowo osobista wizyta w recepcji nie jest wymagana.
  4. Warunkiem otrzymania dostępu do Apartamentu jest w szczególności:
    1. opłacenie 100% wartości Rezerwacji;
    2. uregulowanie wymaganych opłat dodatkowych;
    3. uzupełnienie wymaganych danych meldunkowych;
    4. przekazanie informacji potrzebnych do potwierdzenia tożsamości Gościa;
    5. ustanowienie kaucji lub innego zabezpieczenia, jeżeli jest wymagane;
    6. spełnienie innych warunków wskazanych w potwierdzeniu Rezerwacji.
  5. W dniu przyjazdu Gość otrzymuje wiadomość SMS lub e-mail zawierającą indywidualny kod dostępu oraz instrukcję umożliwiającą wejście do Obiektu i zarezerwowanego Apartamentu.
  6. Kod dostępu aktywowany jest nie wcześniej niż o godzinie 16:00 w dniu przyjazdu, chyba że Wynajmujący potwierdzi możliwość wcześniejszego zameldowania.
  7. Kod dostępu przeznaczony jest wyłącznie dla osób objętych Rezerwacją.
  8. Zabrania się przekazywania kodu dostępu osobom trzecim nieobjętym Rezerwacją.
  9. Gość zobowiązany jest odpowiednio zabezpieczyć otrzymany kod przed dostępem osób nieuprawnionych.
  10. W przypadku problemów z kodem dostępu, wejściem do Obiektu, zamkiem elektronicznym lub wejściem do Apartamentu Gość powinien niezwłocznie skontaktować się z obsługą pod numerem:

  1. Wcześniejsze zameldowanie możliwe jest wyłącznie po wcześniejszym uzgodnieniu z obsługą oraz w zależności od gotowości Apartamentu.
  2. Późniejsze wymeldowanie możliwe jest wyłącznie po wcześniejszym uzgodnieniu z obsługą.
  3. Wcześniejsze zameldowanie lub późniejsze wymeldowanie może wiązać się z dodatkową opłatą.
  4. Gość zobowiązany jest opuścić Apartament najpóźniej do godziny 11:00 w dniu wyjazdu.
  5. Po zakończeniu doby hotelowej indywidualny kod dostępu może zostać automatycznie dezaktywowany.
  6. Nieuprawnione przedłużenie pobytu może skutkować naliczeniem dodatkowej opłaty oraz obciążeniem Gościa udokumentowaną szkodą poniesioną przez Wynajmującego, jeżeli uniemożliwi ono lub utrudni realizację kolejnej Rezerwacji.
  1. Wynajmujący może wymagać ustanowienia kaucji stanowiącej zabezpieczenie roszczeń związanych w szczególności z:
    1. uszkodzeniem Apartamentu;
    2. zniszczeniem lub zagubieniem wyposażenia;
    3. ponadstandardowym sprzątaniem;
    4. naruszeniem Regulaminu;
    5. zagubieniem kluczy, kart, pilotów lub innych urządzeń dostępowych.
  2. Wysokość i sposób ustanowienia kaucji przekazywane są Gościowi przed rozpoczęciem pobytu.
  3. Kaucja może zostać ustanowiona między innymi poprzez preautoryzację środków na karcie płatniczej.
  4. W przypadku braku szkód i innych należności zabezpieczenie zostanie zwolnione zgodnie z warunkami przekazanymi Gościowi.
  5. W przypadku stwierdzenia szkody lub należnych opłat Wynajmujący może potrącić odpowiednią kwotę z kaucji lub dochodzić zapłaty należności przekraczających jej wysokość.
  1. Liczba osób przebywających lub nocujących w Apartamencie nie może przekraczać liczby wskazanej w Rezerwacji ani maksymalnej liczby osób przewidzianej dla danego Apartamentu.
  2. Nocowanie osób nieobjętych Rezerwacją bez wcześniejszej zgody Wynajmującego jest zabronione.
  3. W przypadku stwierdzenia większej liczby osób Wynajmujący może naliczyć dodatkową opłatę lub odmówić dalszej realizacji pobytu, jeżeli doszło do rażącego naruszenia Regulaminu.
  4. Osoby małoletnie mogą przebywać w Obiekcie wyłącznie pod opieką osób dorosłych.
  5. Za pobyt jednego dziecka do ukończenia 2. roku życia, przypadającego na dwoje dorosłych, śpiącego z opiekunami lub we własnym łóżeczku i niewymagającego dodatkowej pościeli, nie pobiera się dodatkowej opłaty za nocleg, chyba że warunki konkretnej oferty stanowią inaczej.
  6. Obecność dziecka, niezależnie od jego wieku, należy zgłosić podczas dokonywania Rezerwacji.
  1. Gość zobowiązany jest korzystać z Apartamentu zgodnie z jego przeznaczeniem, zasadami bezpieczeństwa oraz instrukcjami obsługi urządzeń.
  2. Gość zobowiązany jest utrzymywać Apartament w należytym stanie i porządku.
  3. Przed opuszczeniem Apartamentu w dniu wyjazdu Gość zobowiązany jest w szczególności:
    1. pozostawić umyte używane naczynia i sprzęty kuchenne;
    2. usunąć żywność wymagającą wyrzucenia;
    3. wyrzucić odpady;
    4. pozostawić Apartament w stanie niewymagającym ponadstandardowego sprzątania;
    5. zamknąć okna i drzwi.
  4. Wynajmujący może naliczyć opłatę za ponadstandardowe sprzątanie.
  5. Zabrania się przemieszczania mebli oraz elementów stałego wyposażenia bez zgody Wynajmującego.
  6. Zabrania się wynoszenia wyposażenia Apartamentu poza jego obręb, z wyjątkiem przedmiotów przeznaczonych do korzystania w częściach wspólnych, na balkonie lub tarasie.
  7. Gość zobowiązany jest prawidłowo korzystać z urządzeń elektrycznych, instalacji wodnych, sprzętu kuchennego i pozostałego wyposażenia.
  8. Przy każdorazowym opuszczaniu Apartamentu należy wyłączyć urządzenia, których pozostawienie bez nadzoru może stwarzać zagrożenie.
  9. Zabrania się korzystania z Apartamentu w sposób sprzeczny z prawem, dobrymi obyczajami lub jego przeznaczeniem.
  1. Gość ponosi odpowiedzialność materialną za uszkodzenia, zniszczenia lub braki w wyposażeniu Apartamentu i częściach wspólnych powstałe z jego winy lub z winy osób, za które odpowiada.
  2. Odpowiedzialność może obejmować w szczególności:
    1. koszt naprawy;
    2. koszt zakupu brakującego lub uszkodzonego wyposażenia;
    3. koszt dodatkowego sprzątania;
    4. koszt specjalistycznego czyszczenia;
    5. udokumentowane straty związane z czasowym wyłączeniem Apartamentu z użytkowania.
  3. Gość zobowiązany jest niezwłocznie zgłosić zauważone uszkodzenia, braki lub usterki.
  4. Szkody powstałe podczas pobytu należy zgłaszać bez zbędnej zwłoki.
  1. W Obiekcie obowiązuje cisza nocna w godzinach 22:00–07:00.
  2. Goście zobowiązani są respektować prawo pozostałych osób do spokojnego wypoczynku.
  3. Organizowanie imprez, przyjęć, głośnych spotkań lub innych wydarzeń bez wcześniejszej zgody Wynajmującego jest zabronione.
  4. Naruszenie ciszy nocnej lub konieczność interwencji ochrony albo odpowiednich służb może skutkować naliczeniem kary w wysokości 1000 PLN.
  5. W Apartamentach oraz częściach wspólnych Obiektu obowiązuje całkowity zakaz palenia:
    1. wyrobów tytoniowych;
    2. papierosów elektronicznych;
    3. podgrzewaczy tytoniu;
    4. innych wyrobów powodujących dym, parę lub intensywny zapach.
  6. Naruszenie zakazu palenia może skutkować naliczeniem kary w wysokości 500 PLN oraz kosztów specjalistycznego czyszczenia lub usuwania zapachów.
  7. Zabrania się wyrzucania niedopałków, śmieci i innych przedmiotów przez okna lub balkony.
  8. Rażące lub powtarzające się naruszenie Regulaminu może skutkować nakazaniem opuszczenia Obiektu bez zwrotu ceny za niewykorzystaną część pobytu, w zakresie dopuszczalnym przez obowiązujące przepisy.
  1. Pobyt ze zwierzętami możliwy jest wyłącznie w Apartamentach, dla których warunki konkretnej oferty dopuszczają pobyt zwierząt.
  2. Pobyt zwierzęcia wymaga:
    1. wcześniejszego zgłoszenia;
    2. uzyskania zgody Wynajmującego;
    3. uiszczenia wymaganej opłaty, jeżeli obowiązuje.
  3. Właściciel zwierzęcia ponosi odpowiedzialność za wszelkie szkody, zabrudzenia oraz zakłócenia spowodowane przez zwierzę.
  4. W częściach wspólnych zwierzę powinno pozostawać pod kontrolą właściciela.
  5. Zwierzęta niezgłoszone podczas Rezerwacji nie mogą przebywać w Apartamencie.
  1. Obiekt posiada miejsca postojowe w garażu.
  2. Dostępność miejsca garażowego zależy od warunków konkretnej Rezerwacji.
  3. Sam fakt dokonania Rezerwacji nie gwarantuje miejsca postojowego, jeżeli nie zostało ono wskazane w ofercie lub odrębnie potwierdzone.
  4. Gość zobowiązany jest podać numer rejestracyjny pojazdu, jeżeli wymaga tego obsługa Obiektu.
  5. Gość może korzystać wyłącznie z miejsca postojowego wskazanego lub przypisanego do jego Rezerwacji.
  6. Zabrania się:
    1. zajmowania miejsc przeznaczonych dla innych użytkowników;
    2. parkowania na drogach komunikacyjnych;
    3. blokowania przejazdów;
    4. blokowania przestrzeni manewrowej;
    5. pozostawiania pojazdu na drogach ewakuacyjnych.
  7. Wjazd i wyjazd z garażu odbywa się przy wykorzystaniu windy samochodowej.
  8. Korzystanie z windy samochodowej możliwe jest wyłącznie zgodnie z:
    1. instrukcją obsługi;
    2. oznakowaniem;
    3. komunikatami urządzenia;
    4. poleceniami obsługi Obiektu.
  9. Gość zobowiązany jest zachować szczególną ostrożność podczas wjazdu do windy, ustawiania pojazdu, wyjazdu z windy oraz manewrowania w garażu.
  10. Pojazd powinien zostać ustawiony zgodnie z oznaczeniami znajdującymi się wewnątrz windy.
  11. Zabrania się korzystania z windy samochodowej pojazdem niespełniającym ograniczeń technicznych wskazanych na urządzeniu lub jego oznakowaniu.
  12. Na teren windy samochodowej oraz garażu obowiązuje bezwzględny zakaz wjazdu i parkowania pojazdów wyposażonych w instalację LPG.
  13. Gość posiadający pojazd wyposażony w instalację LPG zobowiązany jest poinformować o tym obsługę i nie może korzystać z podziemnego garażu ani windy samochodowej.
  14. Zabrania się:
  15. blokowania drzwi lub bram windy;
  16. zasłaniania lub blokowania fotokomórek;
  17. ingerowania w zabezpieczenia urządzenia;
  18. samodzielnego uruchamiania urządzenia w przypadku awarii;
  19. samodzielnych napraw;
  20. używania windy niezgodnie z przeznaczeniem.
  21. W przypadku awarii Gość zobowiązany jest zachować spokój, stosować się do komunikatów urządzenia, skorzystać z systemu alarmowego lub kontaktu wskazanego przy windzie oraz nie podejmować prób samodzielnego opuszczania urządzenia lub jego naprawy.
  22. Szczegółowe zasady korzystania z windy samochodowej i garażu zawiera Załącznik nr 1 do niniejszego Regulaminu.
  1. Do dyspozycji Gości Obiektu pozostaje strefa wellness.
  2. Korzystanie ze strefy wellness odbywa się zgodnie z aktualnymi zasadami funkcjonowania Obiektu.
  3. Aktualne godziny funkcjonowania strefy przekazywane są Gościom przez obsługę lub dostępne są na terenie Obiektu.
  4. Strefa wellness przeznaczona jest do wypoczynku, regeneracji i relaksu.
  5. Osoby korzystające ze strefy zobowiązane są:
    1. zachować spokój;
    2. przestrzegać zasad higieny;
    3. korzystać z urządzeń zgodnie z ich przeznaczeniem;
    4. stosować się do oznakowania i poleceń obsługi;
    5. zachować szczególną ostrożność na mokrych i śliskich powierzchniach.
  6. Przed skorzystaniem z urządzeń wodnych lub sauny należy skorzystać z prysznica.
  7. Osoby małoletnie mogą przebywać w strefie wellness wyłącznie pod stałą opieką osoby dorosłej.
  8. Zabrania się w szczególności:
    1. biegania;
    2. popychania innych osób;
    3. skakania do urządzeń wodnych w miejscach do tego nieprzeznaczonych;
    4. zachowań stwarzających zagrożenie;
    5. wnoszenia szklanych przedmiotów i opakowań;
    6. palenia;
    7. spożywania alkoholu i środków odurzających;
    8. korzystania ze strefy pod wpływem alkoholu lub środków odurzających.
  9. Osoby posiadające przeciwwskazania zdrowotne powinny przed skorzystaniem z sauny, jacuzzi lub innych urządzeń wellness skonsultować się z lekarzem.
  10. Ze strefy nie powinny korzystać osoby posiadające otwarte rany, objawy chorób zakaźnych lub inne dolegliwości mogące powodować zagrożenie dla pozostałych użytkowników.
  11. Strefa wellness może zostać czasowo zamknięta w przypadku awarii, konserwacji, przeglądu, dezynfekcji lub innych okoliczności związanych z bezpieczeństwem.
  12. Szczegółowe zasady korzystania ze strefy wellness zawiera Załącznik nr 2 do niniejszego Regulaminu.
  1. Gość zobowiązany jest niezwłocznie zgłaszać obsłudze wszelkie awarie, usterki i nieprawidłowości.
  2. Wynajmujący podejmie działania w celu usunięcia zgłoszonej usterki bez zbędnej zwłoki.
  3. Termin naprawy może być dłuższy, jeżeli wymaga tego charakter usterki, dostępność części, konieczność skorzystania z zewnętrznego serwisu lub okoliczności niezależne od Wynajmującego.
  4. Gość zobowiązany jest umożliwić upoważnionym osobom dostęp do Apartamentu w celu usunięcia awarii, przeprowadzenia koniecznej kontroli, zapobieżenia powstaniu szkody lub usunięcia bezpośredniego zagrożenia dla osób lub mienia.
  5. W sytuacji nagłej, w szczególności w przypadku podejrzenia pożaru, zalania, awarii instalacji albo zagrożenia życia lub zdrowia, upoważnione osoby mogą uzyskać dostęp do Apartamentu bez wcześniejszej zgody Gościa.
  1. W przypadku wystąpienia okoliczności uniemożliwiających udostępnienie zarezerwowanego Apartamentu Wynajmujący może zaproponować Gościowi:
    1. inny Apartament;
    2. lokal zastępczy o porównywalnym standardzie;
    3. zmianę terminu pobytu;
    4. zwrot należności dotyczącej niewykorzystanej części usługi.
  2. Wynajmujący może odstąpić od realizacji Rezerwacji, jeżeli bezpieczeństwo Gościa lub jego mienia nie może zostać zagwarantowane z przyczyn niezależnych od Wynajmującego.
  3. W takim przypadku wpłacone środki podlegają zwrotowi w części dotyczącej usług, które nie zostały wykonane.
  1. Gość powinien przed wymeldowaniem dokładnie sprawdzić Apartament i zabrać wszystkie należące do niego rzeczy.
  2. Rzeczy znalezione po zakończeniu pobytu mogą zostać zabezpieczone przez obsługę.
  3. Gość powinien możliwie szybko skontaktować się z Wynajmującym w celu identyfikacji pozostawionego przedmiotu.
  4. Przesłanie pozostawionej rzeczy może nastąpić na koszt Gościa.
  5. Artykuły spożywcze, środki higieniczne i przedmioty, których przechowywanie jest niemożliwe, niebezpieczne albo nieuzasadnione ze względów sanitarnych, mogą zostać usunięte.
  1. Gość zobowiązany jest odpowiednio zabezpieczyć należące do niego przedmioty wartościowe.
  2. Wynajmujący nie odpowiada za przedmioty pozostawione bez nadzoru, chyba że odpowiedzialność taka wynika z obowiązujących przepisów prawa lub szkoda powstała z winy Wynajmującego.
  3. Powyższe dotyczy w szczególności przedmiotów pozostawionych:
    1. w częściach wspólnych;
    2. w garażu;
    3. w pojeździe;
    4. w strefie wellness.
  1. Gość ma prawo zgłosić reklamację dotyczącą Rezerwacji, pobytu lub usług świadczonych przez Wynajmującego.
  2. Usterki i nieprawidłowości możliwe do usunięcia podczas pobytu należy zgłaszać niezwłocznie.
  3. Reklamację można przesłać pocztą elektroniczną na adres:

  1. Reklamacja powinna zawierać w szczególności:
    1. imię i nazwisko Gościa;
    2. dane kontaktowe;
    3. numer Rezerwacji, jeżeli jest dostępny;
    4. termin pobytu;
    5. opis zgłaszanej nieprawidłowości;
    6. oczekiwany sposób rozwiązania sprawy.
  2. Reklamacje rozpatrywane są zgodnie z obowiązującymi przepisami prawa.

  1. Administrator może przetwarzać dane osobowe niezbędne między innymi do:
    1. dokonania i realizacji Rezerwacji;
    2. obsługi pobytu;
    3. obsługi płatności;
    4. rozliczenia usług;
    5. ustanowienia i rozliczenia kaucji;
    6. obsługi reklamacji;
    7. zapewnienia bezpieczeństwa;
    8. dochodzenia lub obrony roszczeń.
  2. Podanie danych niezbędnych do realizacji Rezerwacji jest dobrowolne, jednak ich niepodanie może uniemożliwić zawarcie lub wykonanie umowy.
  3. Osobom, których dane są przetwarzane, przysługują prawa wynikające z obowiązujących przepisów dotyczących ochrony danych osobowych, w tym RODO.
  1. W sprawach nieuregulowanych niniejszym Regulaminem zastosowanie mają przepisy prawa polskiego.
  2. Integralną część Regulaminu stanowią:
    1. Załącznik nr 1 – Regulamin windy samochodowej i garażu Mountala;
    2. Załącznik nr 2 – Regulamin strefy wellness Mountala.
  3. Gość zobowiązany jest również przestrzegać instrukcji bezpieczeństwa, oznakowania i komunikatów znajdujących się na terenie Obiektu.
  4. Wynajmujący może zmieniać treść Regulaminu zgodnie z obowiązującymi przepisami prawa.
  5. Zmiany Regulaminu nie wpływają na warunki Rezerwacji zawartych przed ich wejściem w życie, chyba że obowiązujące przepisy stanowią inaczej lub strony uzgodnią inaczej.
  6. Regulamin wchodzi w życie z dniem jego publikacji.

LEX KAMILEK – STANDARDY OCHRONY MAŁOLETNICH

W Obiekcie obowiązują Standardy Ochrony Małoletnich, określające zasady i procedury mające na celu zapewnienie bezpieczeństwa dzieci przebywających w Obiekcie.

Goście przebywający w Obiekcie z osobami małoletnimi zobowiązani są do przestrzegania obowiązujących Standardów Ochrony Małoletnich oraz do współpracy z personelem Obiektu w zakresie działań podejmowanych w celu zapewnienia bezpieczeństwa dzieci.

W przypadku uzasadnionego podejrzenia, że bezpieczeństwo osoby małoletniej jest zagrożone, personel Obiektu może podjąć działania zgodne z obowiązującymi Standardami Ochrony Małoletnich oraz obowiązującymi przepisami prawa.

REGULAMIN WINDY SAMOCHODOWEJ I GARAŻU

MOUNTALA

  1. Winda samochodowa przeznaczona jest do transportu pojazdów pomiędzy poziomem wjazdowym a garażem Obiektu.
  2. Z windy mogą korzystać wyłącznie osoby uprawnione do korzystania z garażu.
  3. Korzystanie z windy odbywa się zgodnie z instrukcją, oznakowaniem, komunikatami urządzenia oraz poleceniami obsługi.
  4. Przed wjazdem Gość zobowiązany jest upewnić się, że:
    1. urządzenie jest gotowe do przyjęcia pojazdu;
    2. drzwi lub brama są całkowicie otwarte;
    3. wjazd może odbyć się bezpiecznie;
    4. pojazd spełnia ograniczenia techniczne wskazane przy urządzeniu.
  5. Do windy należy wjeżdżać powoli i z zachowaniem szczególnej ostrożności.
  6. Pojazd należy ustawić zgodnie z oznaczeniami znajdującymi się wewnątrz windy.
  7. Zabrania się:
    1. przekraczania ograniczeń technicznych windy;
    2. gwałtownego wjeżdżania lub wyjeżdżania;
    3. blokowania drzwi lub bram;
    4. blokowania fotokomórek lub czujników;
    5. ingerowania w zabezpieczenia urządzenia;
    6. samodzielnego dokonywania napraw;
    7. wykorzystywania windy niezgodnie z jej przeznaczeniem.
  8. Obowiązuje bezwzględny zakaz korzystania z windy samochodowej oraz garażu przez pojazdy wyposażone w instalację LPG.
  9. Gość posiadający pojazd z instalacją LPG zobowiązany jest poinformować o tym obsługę Obiektu i nie może korzystać z podziemnego garażu ani windy samochodowej.
  10. Gość korzystający z garażu zobowiązany jest parkować wyłącznie na miejscu postojowym wskazanym lub przypisanym do Rezerwacji.
  11. Zabrania się zajmowania miejsc przeznaczonych dla innych użytkowników.
  12. Zabrania się parkowania:
  13. na drogach komunikacyjnych;
  14. w przestrzeni manewrowej;
  15. przy bramach i wejściach;
  16. na drogach ewakuacyjnych;
  17. w bezpośredniej strefie wjazdu i wyjazdu z windy.
  18. Zabrania się pozostawiania w garażu paliwa, materiałów łatwopalnych, materiałów wybuchowych oraz innych substancji lub przedmiotów mogących powodować zagrożenie.
  19. W przypadku zauważenia awarii lub nieprawidłowości należy przerwać korzystanie z windy i poinformować obsługę.
  20. W przypadku zatrzymania windy należy:
  21. zachować spokój;
  22. stosować się do komunikatów urządzenia;
  23. użyć systemu alarmowego lub kontaktu wskazanego przy windzie;
  24. oczekiwać na pomoc.
  25. Zabrania się podejmowania prób samodzielnego opuszczania unieruchomionej windy, otwierania jej drzwi lub ingerowania w urządzenie.
  26. Gość odpowiada za szkody powstałe wskutek zawinionego, niewłaściwego lub niezgodnego z Regulaminem korzystania z windy lub garażu.
  27. Instrukcja producenta oraz aktualne oznakowanie urządzenia mają pierwszeństwo w zakresie technicznego sposobu użytkowania windy.

REGULAMIN STREFY WELLNESS

MOUNTALA

  1. Strefa wellness przeznaczona jest przede wszystkim dla Gości Obiektu Mountala.
  2. Korzystanie ze strefy odbywa się zgodnie z jej przeznaczeniem, oznakowaniem i poleceniami obsługi.
  3. Aktualne godziny funkcjonowania strefy wellness dostępne są w Obiekcie lub w informacjach przekazywanych Gościom.
  4. Strefa wellness jest miejscem wypoczynku i relaksu.
  5. Goście zobowiązani są zachowywać się w sposób niezakłócający wypoczynku innych osób.
  6. Przed skorzystaniem z urządzeń wodnych lub sauny należy dokładnie umyć ciało pod prysznicem.
  7. Na mokrych powierzchniach należy zachować szczególną ostrożność.
  8. Zaleca się korzystanie z odpowiedniego obuwia basenowego.
  9. Osoby małoletnie mogą korzystać ze strefy wyłącznie pod stałym nadzorem osoby dorosłej.
  10. Opiekun ponosi odpowiedzialność za bezpieczeństwo osoby małoletniej pozostającej pod jego opieką.
  11. W strefie wellness zabrania się:
  12. biegania;
  13. popychania innych osób;
  14. skakania do urządzeń wodnych w miejscach do tego nieprzeznaczonych;
  15. zachowań mogących powodować zagrożenie;
  16. wnoszenia szklanych opakowań i przedmiotów;
  17. palenia tytoniu i wyrobów nikotynowych;
  18. spożywania alkoholu;
  19. spożywania środków odurzających;
  20. korzystania ze strefy pod wpływem alkoholu lub środków odurzających;
  21. samodzielnej regulacji lub naprawy urządzeń technicznych.
  22. Ze strefy nie powinny korzystać osoby posiadające otwarte rany, objawy chorób zakaźnych lub stan zdrowia mogący stwarzać zagrożenie dla nich samych albo innych osób.
  23. Osoby posiadające przeciwwskazania zdrowotne, w szczególności związane z chorobami układu krążenia, układu oddechowego, ciążą lub przyjmowanymi lekami, powinny przed skorzystaniem z sauny, jacuzzi lub innych urządzeń skonsultować się z lekarzem.
  24. Cenne przedmioty należy odpowiednio zabezpieczyć i nie pozostawiać ich bez nadzoru.
  25. Wszelkie awarie i nieprawidłowości należy niezwłocznie zgłaszać obsłudze.
  26. Obsługa może odmówić dalszego korzystania ze strefy osobie naruszającej Regulamin, zachowującej się w sposób niebezpieczny lub zakłócającej wypoczynek innych Gości.
  27. Strefa wellness może zostać czasowo zamknięta ze względów technicznych, sanitarnych, konserwacyjnych, organizacyjnych lub związanych z bezpieczeństwem.
  28. Gość odpowiada za szkody wyrządzone w wyposażeniu strefy wellness z jego winy lub z winy osób pozostających pod jego opieką.

BOOKING AND STAY TERMS AND CONDITIONS

MOUNTALA

  1. These Terms and Conditions define the rules for making reservations and using apartments located at the Mountala property in Zakopane, hereinafter referred to as the “Property”.
  2. The following terms shall have the following meanings:
    1. Property – Mountala in Zakopane;
    2. Apartment – an apartment, room or other accommodation unit located within the Property and covered by a Reservation;
    3. Guest – a person making a Reservation or staying in an Apartment;
    4. Lessor – GÓRSKA GRUPA HOTELOWA SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Zakopane, ul. Chyców Potok 26/P.II, 34-500 Zakopane, entered in the Register of Entrepreneurs of the National Court Register under KRS No. 0001095970, NIP 7361748232;
    5. Reservation – an agreement concerning the paid provision of an Apartment to the Guest for a specified period;
    6. Flexible Offer – an offer allowing the Reservation to be cancelled under the conditions set out in these Terms and Conditions;
    7. Non-Refundable Offer – an offer under which the Guest waives the possibility of free cancellation of the Reservation.
  3. The Lessor may be contacted:

  1. Making a Reservation means that the Guest has read these Terms and Conditions, accepts their content and agrees to comply with them.
  2. A Guest making a Reservation on behalf of other persons is required to provide them with the content of these Terms and Conditions.
  3. The Guest is responsible for compliance with these Terms and Conditions by all persons included in the Reservation, minors under the Guest’s supervision and visitors.
  4. The agreement between the Guest and the Lessor may be concluded through a website, booking system, email, telephone, third-party booking portal or another method accepted by the Lessor.
  5. Prices presented through sales channels may change. The price binding on the Guest is the price stated in the Reservation confirmation.
  6. Standard utility consumption costs are included in the accommodation price unless the conditions of a particular offer provide otherwise.
  7. Photographs of Apartments are for information purposes. Minor differences in decorations, arrangement or appearance of equipment are permitted provided that they do not materially affect the standard, functionality or intended use of the Apartment.
  1. Reservations may be made:
    1. through the available booking system;
    2. by email at rezerwacja@gorskagrupa.pl;
    3. by phone at +48 535 391 391;
    4. through cooperating third-party booking portals.
  2. In order to make a Reservation, the Guest must provide true and complete information required to process it, including in particular:
    1. name and surname;
    2. email address;
    3. telephone number;
    4. dates of stay;
    5. number of persons;
    6. number and age of children;
    7. other information necessary to process the Reservation.
  3. The Guest must immediately inform the Lessor of any change to the information provided during the Reservation process.
  4. After the Reservation has been made, the Lessor sends the Guest a confirmation including in particular:
    1. dates of stay;
    2. name or number of the Apartment;
    3. number of Guests;
    4. accommodation price;
    5. amount and deadline of the required payment;
    6. cancellation conditions;
    7. check-in information.
  5. The Reservation is confirmed once accepted by the Lessor and the required payment has been made.
  6. Failure to make the required payment within the applicable deadline may result in cancellation of the Reservation.
  7. If the Reservation is made through a third-party booking portal, the conditions of that portal may also apply. With regard to payment, changes and cancellation, the conditions accepted by the Guest in the relevant sales channel shall apply.
  1. Under the Flexible Offer, the Guest is required to pay 100% of the Reservation value at the time of booking.
  2. A Guest using the Flexible Offer may cancel the Reservation and receive a 100% refund of the amount paid, provided that cancellation takes place:
    1. no later than 5 days before the scheduled arrival date – for Reservations during the low season;
    2. no later than 14 days before the scheduled arrival date – for Reservations during the high season and special dates.
  3. Special dates include in particular:
    • public holidays and holiday periods;
    • winter school holidays;
    • long weekends;
    • New Year’s Eve and New Year periods;
    • summer holidays;
    • other periods specified as special in the conditions of a particular offer.
  1. Low-season and high-season dates may vary from year to year.
  2. Information about the conditions applicable to a specific Reservation is provided to the Guest before confirmation.
  3. If a Reservation is cancelled within the free-cancellation period, the full amount paid will be refunded within 7 business days from the effective submission of the cancellation notice.
  4. If the Reservation is cancelled after the deadlines specified above, the Reservation price paid is non-refundable.
  5. If the Reservation is made within a period shorter than the applicable free-cancellation period, payment of 100% of the Reservation value is required and the amount paid will not be refunded if the Guest cancels the Reservation.
  6. A cancellation notice should be sent to:

or submitted by another method specified in the Reservation confirmation.

  1. The Lessor may offer special accommodation conditions under a Non-Refundable Offer.
  2. Under the Non-Refundable Offer, the Guest is required to pay 100% of the Reservation value at the time of booking.
  3. If the Guest cancels the Reservation, the amount paid is non-refundable.
  4. Free changes to the dates or other conditions of a Non-Refundable Reservation are not possible unless the Lessor gives individual consent.
  1. Any modification to the Reservation, including changes to the dates of stay, Apartment, number of Guests or scope of services, requires the Lessor’s approval.
  2. The possibility of making a change depends in particular on:
    1. Apartment availability;
    2. conditions of the selected offer;
    3. current prices;
    4. the amount of time remaining before the beginning of the stay.
  3. A Reservation change becomes effective once confirmed by the Lessor by electronic message or another durable medium.
  4. The Guest may transfer the Reservation to another person after agreeing this with the Lessor.
  5. The person taking over the Reservation must accept its conditions and provide the information required to process the stay.
  1. The hotel day begins at 4:00 PM on the day of arrival and ends at 11:00 AM on the day of departure.
  2. Mountala operates a remote check-in system.
  3. As a standard rule, an in-person visit to reception is not required.
  4. Access to the Apartment is conditional in particular on:
    1. payment of 100% of the Reservation value;
    2. payment of all required additional charges;
    3. completion of the required registration details;
    4. provision of information required to confirm the Guest’s identity;
    5. establishment of a security deposit or other security, where required;
    6. fulfilment of any other conditions stated in the Reservation confirmation.
  5. On the day of arrival, the Guest receives an SMS or email containing an individual access code and instructions necessary to enter the Property and the reserved Apartment.
  6. The access code is activated no earlier than 4:00 PM on the day of arrival, unless the Lessor confirms that early check-in is available.
  7. The access code is intended exclusively for persons included in the Reservation.
  8. The access code must not be shared with third parties who are not included in the Reservation.
  9. The Guest must properly secure the access code against unauthorized use.
  10. In the event of problems with the access code, entry to the Property, electronic lock or entry to the Apartment, the Guest should immediately contact the service team at:

  1. Early check-in is possible only by prior agreement with the service team and subject to the Apartment being ready.
  2. Late check-out is possible only by prior agreement with the service team.
  3. Early check-in or late check-out may be subject to an additional fee.
  4. The Guest must leave the Apartment no later than 11:00 AM on the day of departure.
  5. After the end of the hotel day, the individual access code may be automatically deactivated.
  6. Unauthorized extension of the stay may result in an additional charge and the Guest being charged documented losses incurred by the Lessor if this prevents or disrupts the fulfilment of a subsequent Reservation.
  1. The Lessor may require a security deposit to secure claims relating in particular to:
    1. damage to the Apartment;
    2. destruction or loss of equipment;
    3. excessive cleaning;
    4. violation of these Terms and Conditions;
    5. loss of keys, cards, remotes or other access devices.
  2. The amount and method of providing the security deposit will be communicated to the Guest before the beginning of the stay.
  3. The security deposit may be provided, among other methods, by way of a pre-authorization on a payment card.
  4. If no damage or other charges are identified, the security will be released in accordance with the conditions communicated to the Guest.
  5. If damage or other amounts due are identified, the Lessor may deduct the relevant amount from the security deposit or seek payment of any amount exceeding it.
  1. The number of persons staying or sleeping in the Apartment may not exceed the number stated in the Reservation or the maximum occupancy of the Apartment.
  2. Overnight stays by persons not included in the Reservation are prohibited without the Lessor’s prior approval.
  3. If more persons are found to be staying in the Apartment, the Lessor may charge an additional fee or refuse further provision of the stay in the event of a serious violation of these Terms and Conditions.
  4. Minors may stay at the Property only under the supervision of adults.
  5. One child under 2 years of age, per two adults, sleeping with the guardians or in their own cot and not requiring additional bed linen, may stay without an additional accommodation charge unless the conditions of a particular offer provide otherwise.
  6. The presence of a child, regardless of age, must be declared when making the Reservation.
  1. The Guest must use the Apartment in accordance with its intended purpose, safety rules and operating instructions.
  2. The Guest must maintain the Apartment in proper condition and order.
  3. Before leaving the Apartment on the day of departure, the Guest must in particular:
    1. leave used dishes and kitchen equipment washed;
    2. remove food that needs to be disposed of;
    3. dispose of waste;
    4. leave the Apartment in a condition that does not require excessive cleaning;
    5. close windows and doors.
  4. The Lessor may charge the Guest for excessive cleaning.
  5. Moving furniture or fixed equipment without the Lessor’s consent is prohibited.
  6. Removing equipment from the Apartment is prohibited, except for items intended for use in common areas, on balconies or terraces.
  7. The Guest must use electrical devices, water installations, kitchen equipment and other equipment correctly.
  8. Whenever leaving the Apartment, the Guest must switch off devices that could create a hazard if left unattended.
  9. The Apartment may not be used in a manner contrary to law, good customs or its intended purpose.
  1. The Guest is financially responsible for damage, destruction or missing equipment in the Apartment or common areas caused by the Guest or persons for whom the Guest is responsible.
  2. Liability may include in particular:
    1. repair costs;
    2. replacement costs for missing or damaged equipment;
    3. additional cleaning costs;
    4. specialist cleaning costs;
    5. documented losses resulting from temporary withdrawal of the Apartment from use.
  3. The Guest must immediately report any noticed damage, missing equipment or defects.
  4. Damage occurring during the stay must be reported without undue delay.
  1. Quiet hours apply at the Property between 10:00 PM and 7:00 AM.
  2. Guests must respect the right of other persons to peaceful rest.
  3. Parties, receptions, loud gatherings or other events without the Lessor’s prior approval are prohibited.
  4. Violation of quiet hours or the need for security or emergency-service intervention may result in a charge of PLN 1,000.
  5. Smoking is strictly prohibited in Apartments and all common areas, including:
    1. tobacco products;
    2. electronic cigarettes;
    3. heated tobacco products;
    4. other products producing smoke, vapour or an intense smell.
  6. Violation of the smoking ban may result in a PLN 500 charge and additional specialist cleaning or odour-removal costs.
  7. Throwing cigarette butts, rubbish or other objects through windows or from balconies is strictly prohibited.
  8. Serious or repeated violation of these Terms and Conditions may result in the Guest being required to leave the Property without a refund for the unused part of the stay, to the extent permitted by applicable law.
  1. Pets are permitted only in Apartments where the conditions of the particular offer allow pets.
  2. A pet stay requires:
    1. prior notification;
    2. the Lessor’s consent;
    3. payment of any applicable pet fee.
  3. The pet owner is responsible for all damage, dirt and disturbance caused by the animal.
  4. In common areas the animal must remain under the owner’s control.
  5. Pets not declared during the Reservation process may not stay in the Apartment.
  1. The Property has parking spaces located in a garage.
  2. Availability of a garage parking space depends on the conditions of the particular Reservation.
  3. Making a Reservation does not by itself guarantee a parking space unless it has been included in the offer or separately confirmed.
  4. The Guest must provide the vehicle registration number if requested by the Property staff.
  5. The Guest may use only the parking space indicated or assigned to their Reservation.
  6. It is prohibited to:
    1. occupy parking spaces assigned to other users;
    2. park on access roads;
    3. block passageways;
    4. block manoeuvring areas;
    5. park on evacuation or emergency routes.
  7. Entry to and exit from the garage take place using a car lift.
  8. The car lift may be used only in accordance with:
    1. operating instructions;
    2. signage;
    3. device messages;
    4. instructions given by Property staff.
  9. The Guest must exercise particular caution when entering the lift, positioning the vehicle, leaving the lift and manoeuvring in the garage.
  10. The vehicle must be positioned in accordance with the markings inside the car lift.
  11. Vehicles that do not comply with the technical restrictions displayed on or near the device may not use the car lift.
  12. Vehicles equipped with an LPG installation are strictly prohibited from entering or parking in the car lift or garage.
  13. A Guest whose vehicle is equipped with an LPG installation must inform the service team and may not use the underground garage or car lift.
  14. It is prohibited to block lift doors or gates, block photocells or sensors, interfere with safety systems, attempt to restart the device independently in the event of a failure, carry out repairs or use the car lift contrary to its intended purpose.
  15. In the event of a failure, the Guest must remain calm, follow the device messages, use the alarm system or contact details displayed near the lift and must not attempt to leave or repair the device independently.
  16. Detailed rules for using the car lift and garage are set out in Appendix No. 1 to these Terms and Conditions.
  1. A wellness area is available to Guests of the Property.
  2. The wellness area may be used in accordance with the current operating rules of the Property.
  3. Current opening hours are communicated by the service team or displayed within the Property.
  4. The wellness area is intended for rest, regeneration and relaxation.
  5. Persons using the wellness area must:
    1. behave calmly;
    2. follow hygiene rules;
    3. use equipment in accordance with its intended purpose;
    4. comply with signage and staff instructions;
    5. exercise particular caution on wet and slippery surfaces.
  6. Guests must shower before using water facilities or the sauna.
  7. Minors may remain in the wellness area only under continuous adult supervision.
  8. It is prohibited to run, push other persons, jump into water facilities in areas not intended for jumping, behave in a manner creating a danger, bring glass objects or containers, smoke, consume alcohol or intoxicating substances, or use the wellness area while under the influence of alcohol or intoxicating substances.
  9. Persons with medical contraindications should consult a doctor before using the sauna, jacuzzi or other wellness facilities.
  10. Persons with open wounds, symptoms of infectious diseases or other conditions that could pose a risk to other users should not use the wellness area.
  11. The wellness area may be temporarily closed due to breakdown, maintenance, inspection, disinfection or other safety-related circumstances.
  12. Detailed wellness rules are set out in Appendix No. 2 to these Terms and Conditions.
  1. The Guest must immediately report all breakdowns, defects and irregularities to the service team.
  2. The Lessor will take steps to remedy reported defects without undue delay.
  3. The repair period may be longer if required by the nature of the defect, availability of parts, the need to use an external service provider or circumstances beyond the Lessor’s control.
  4. The Guest must allow authorized persons access to the Apartment for the purpose of repairing a failure, carrying out a necessary inspection, preventing damage or eliminating an immediate threat to persons or property.
  5. In an emergency, including suspected fire, flooding, installation failure or threat to life or health, authorized persons may access the Apartment without the Guest’s prior consent.
  1. If circumstances arise that prevent the reserved Apartment from being provided, the Lessor may offer the Guest:
    1. another Apartment;
    2. substitute accommodation of a comparable standard;
    3. a change of dates;
    4. a refund of the amount relating to the unused portion of the service.
  2. The Lessor may withdraw from the Reservation if the safety of the Guest or their property cannot be guaranteed due to circumstances beyond the Lessor’s control.
  3. In such circumstances, amounts paid will be refunded in respect of services that have not been provided.
  1. Before check-out, the Guest should carefully inspect the Apartment and remove all personal belongings.
  2. Items found after the end of the stay may be secured by the service team.
  3. The Guest should contact the Lessor as soon as possible in order to identify the item left behind.
  4. Shipment of an item left behind may take place at the Guest’s expense.
  5. Food, hygiene products and items that cannot reasonably or safely be stored may be disposed of.
  1. Guests are responsible for appropriately securing their valuable belongings.
  2. The Lessor is not responsible for items left unattended unless such liability arises under applicable law or the loss was caused by the Lessor.
  3. This applies in particular to property left:
    1. in common areas;
    2. in the garage;
    3. inside a vehicle;
    4. in the wellness area.
  1. The Guest may submit a complaint regarding the Reservation, stay or services provided by the Lessor.
  2. Defects and irregularities that can be remedied during the stay should be reported immediately.
  3. Complaints may be submitted by email to:

  1. A complaint should include in particular:
    1. the Guest’s name and surname;
    2. contact details;
    3. Reservation number, if available;
    4. dates of stay;
    5. description of the reported issue;
    6. expected method of resolving the matter.
  2. Complaints are handled in accordance with applicable law.

  1. Personal data may be processed as necessary for, among other purposes:
    1. making and processing the Reservation;
    2. servicing the stay;
    3. processing payments;
    4. accounting and settlement of services;
    5. establishment and settlement of the security deposit;
    6. processing complaints;
    7. ensuring safety and security;
    8. establishing, pursuing or defending claims.
  2. Providing personal data necessary to process the Reservation is voluntary, but failure to provide it may make it impossible to conclude or perform the agreement.
  3. Persons whose data is processed have the rights provided for under applicable data protection law, including the GDPR.
  1. Matters not regulated by these Terms and Conditions are governed by Polish law.
  2. The following form an integral part of these Terms and Conditions:
    1. Appendix No. 1 – Mountala Car Lift and Garage Regulations;
    2. Appendix No. 2 – Mountala Wellness Area Regulations.
  3. Guests must also comply with safety instructions, signage and messages displayed throughout the Property.
  4. The Lessor may amend these Terms and Conditions in accordance with applicable law.
  5. Amendments to these Terms and Conditions do not affect Reservations concluded before the amendments enter into force unless applicable law provides otherwise or the parties agree otherwise.
  6. These Terms and Conditions enter into force on the date of publication.

LEX KAMILEK – STANDARDS FOR THE PROTECTION OF MINORS

The Property applies Standards for the Protection of Minors, setting out rules and procedures intended to ensure the safety of children staying at the Property.

Guests staying at the Property with minors are required to comply with the applicable Standards for the Protection of Minors and to cooperate with Property staff in matters relating to the safety and protection of children.

Where there is reasonable suspicion that the safety of a minor may be at risk, Property staff may take action in accordance with the applicable Standards for the Protection of Minors and applicable law.

APPENDIX NO. 1

CAR LIFT AND GARAGE REGULATIONS

MOUNTALA

  1. The car lift is intended for transporting vehicles between the entrance level and the Property’s garage.
  2. The car lift may be used only by persons authorized to use the garage.
  3. The car lift must be used in accordance with the instructions, signage, device messages and instructions given by Property staff.
  4. Before entering the lift, the Guest must ensure that:
    1. the device is ready to accept the vehicle;
    2. the doors or gate are fully open;
    3. entry can be carried out safely;
    4. the vehicle complies with the technical limitations displayed at the device.
  5. The vehicle must enter the lift slowly and with particular caution.
  6. The vehicle must be positioned in accordance with the markings inside the lift.
  7. It is prohibited to:
    1. exceed the technical limitations of the lift;
    2. enter or leave the lift suddenly or at excessive speed;
    3. block doors or gates;
    4. block photocells or sensors;
    5. interfere with safety systems;
    6. carry out repairs independently;
    7. use the lift contrary to its intended purpose.
  8. Vehicles equipped with an LPG installation are strictly prohibited from using the car lift or garage.
  9. A Guest whose vehicle is equipped with an LPG installation must inform the Property staff and may not use the underground garage or car lift.
  10. A Guest using the garage must park only in the parking space indicated or assigned to the Reservation.
  11. Parking in spaces assigned to other users is prohibited.
  12. Parking is prohibited:
  13. on access roads;
  14. in manoeuvring areas;
  15. next to gates and entrances;
  16. on evacuation or emergency routes;
  17. immediately in front of or behind the car lift.
  18. It is prohibited to store fuel, flammable materials, explosive materials or other substances or objects capable of creating a hazard in the garage.
  19. If a fault or irregularity is noticed, use of the lift must be stopped and the service team informed.
  20. If the lift stops unexpectedly, the Guest must:
  21. remain calm;
  22. follow the device messages;
  23. use the alarm system or contact details displayed at the lift;
  24. wait for assistance.
  25. Guests must not attempt to leave a disabled lift independently, open its doors or interfere with the device.
  26. The Guest is liable for damage resulting from culpable, improper or non-compliant use of the car lift or garage.
  27. The manufacturer’s instructions and current signage displayed at the device take precedence with regard to the technical operation of the car lift.

APPENDIX NO. 2

WELLNESS AREA REGULATIONS

MOUNTALA

  1. The wellness area is intended primarily for Guests staying at Mountala.
  2. The wellness area must be used in accordance with its intended purpose, signage and staff instructions.
  3. Current opening hours are displayed at the Property or communicated to Guests.
  4. The wellness area is intended for rest and relaxation.
  5. Guests must behave in a manner that does not disturb the comfort and relaxation of others.
  6. Before using water facilities or the sauna, Guests must thoroughly shower.
  7. Particular caution must be exercised on wet surfaces.
  8. Appropriate pool footwear is recommended.
  9. Minors may use the wellness area only under continuous adult supervision.
  10. The supervising adult is responsible for the safety of the minor under their care.
  11. It is prohibited to:
  12. run;
  13. push other persons;
  14. jump into water facilities in places not intended for jumping;
  15. behave in a way that may create a danger;
  16. bring glass containers or objects;
  17. smoke tobacco or nicotine products;
  18. consume alcohol;
  19. consume intoxicating substances;
  20. use the wellness area while under the influence of alcohol or intoxicating substances;
  21. independently adjust or repair technical equipment.
  22. Persons with open wounds, symptoms of infectious diseases or medical conditions that may pose a danger to themselves or other persons should not use the wellness area.
  23. Persons with health contraindications, including cardiovascular or respiratory conditions, pregnancy or medication-related contraindications, should consult a doctor before using the sauna, jacuzzi or other wellness facilities.
  24. Valuable belongings should be properly secured and not left unattended.
  25. All breakdowns and irregularities must be immediately reported to the service team.
  26. The service team may refuse further use of the wellness area to a person who violates these Regulations, behaves in an unsafe manner or disturbs the comfort of other Guests.
  27. The wellness area may be temporarily closed for technical, sanitary, maintenance, organizational or safety reasons.
  28. The Guest is responsible for damage to the wellness area equipment caused by the Guest or persons under their supervision.
